The use of a name or sign which have not been registered as national or international marks can create significant harm by violating rights obtained previously by other Romanian or foreigner titulars.

The firms correctly registered at the Trade Register with a certain mark (sign) can lose it legally in favour of those who can prove they were the first to protect it at the State authorized protection organism, that is they have registration certificate for their trademarks delivered by the State Office for Inventions and Trademarks (OSIM).

Registered trademarks can be recognized by applying on the sign ™ next to the product, trade or office mark.
